Terms and Conditions

Please read these Terms & Conditions carefully as they govern the relationship between You and KL Motorsport Ltd, and they may affect Your legal rights when purchasing Goods from us.

All Orders accepted by KL Motorsport Ltd. will be subject to these Terms & Conditions, which form part of the Contract of Sale.  No variation to this will be accepted unless agreed in advance, in writing, by KL Motorsport Ltd.

Whilst every effort has been made to ensure the accuracy of our website, we do not accept liability for errors or omissions.  We reserve the right to amend or change these Terms & Conditions at any time.

1.           Definitions

1.1.        The ‘Company’, ‘us’, &/or ‘we’, means KL Motorsport Ltd.

1.2.        You’ means the ‘Purchaser’, which is any business, individual, or other body who buys or agrees to buy Goods from the Company.

1.3.        Contract’ means any Contract between You and the Company for the purchase of Goods from us, accepting and incorporating these Terms & Conditions.

1.4.        ‘Order’ means any Order for Goods made by You, in accordance with the Terms & Conditions here in.

1.5.        ‘Goods’ means an individual product or item described on this website. 

 

2.           Orders

2.1.        All Orders accepted by the Company are subject to these Terms & Conditions.

2.2.        When You place an Order with us, it will be regarded as an offer by You to purchase the item/s in question from the Company.

2.3.        Orders will only be accepted after payment for the Goods, and services arising from the purchase, is received in full.

2.4.        Title and ownership of the Goods shall remain with the Company until full payment has been received.

2.5.        We reserve the right to refuse to accept Your Order, whether or not payment has been received by us, without limitation or reason, in particular but not limited to the following.
2.5.1 We do not have sufficient stock of the Goods Ordered to fulfil Your Order.
2.5.2 We are unable to deliver to Your geographical area.
2.5.3 The product or service Ordered is incorrectly listed due to pricing ortypographical errors, or is listed as a result incorrect information provided by our suppliers or other 3rd party.
2.5.4 If we refuse Your Order, we are obliged to advise You in writing /by e-mail, and refund to You any payment made to us as soon as practicallypossible, but in any event within 30 days of Your Order. We are not obliged tooffer any further compensation. 

            2.5.5 For reasons outside our control(please refer to Section 4.8; Force Majeure)


 

3.           Price

3.1        Our website sets out, in good faith, the description and prices for a selection of partsfrom our product range. We cannot be held responsible for any inaccuracies and we reserve the right to vary our prices from time to time.

3.2        Website photographs may show multiple images of the same item. This is for illustrative purposes only. All products are offered and priced as ‘single’ items, unless otherwise specified.

3.3        All prices are quoted excluding VAT, packing, and shipping. All Orders are processed in ‘£ - GBPounds Sterling’ according to prices displayed at time of Ordering. VAT will be charged, and shown separately, at the current applicable rate.

3.4        Payment for Goods Ordered on-line may be made using the following Credit / Debit Cards; Visa, MasterCard, Maestro, Electron. Payments by cash or cheque are also welcomed; please telephone the Company to arrange this.

3.5        Overseas Credit Card Payments (purchases from outside the UK) are accepted; Credit card Companies will calculate the prevailing exchange ratefrom £- GB Pounds into the purchaser’s local currency, and charge for the transaction accordingly. KL Motorsport Ltd.,does not accept responsibility for, or display, or calculate any currency exchange rates.

3.6        When You place an Order You are undertaking to us that all details You provide for the purpose of purchasing the Goods are correct. Furthermore, that any credit or debit card used to make a purchase from us is Your own card, and/or You are authorised to use it, and that there are sufficient available funds to cover the cost of any Goods Ordered from us.

3.7        The KL Motorsport Ltd website uses standard secure login protocols. When purchasing Goods, Your credit card details are not stored. All credit card transactions are processed and handled by RBS Worldpay.

 

 

4.0 Delivery / Shipping:

4.1        Normal UK delivery charges will be displayed separately and charged accordingly. You may be required to pay extra for delivery to certain locations, and it might not be possible for us to deliver to some geographical areas.

4.2        We will deliver the Goods Ordered by You to the delivery address You provide to us at the time You make Your Order.

4.3        Delivery will be made as soon as possible after Your Order is accepted. In any event, this will be within 30 days of Your Order.

4.4        Upon delivery of the Goods, a signature will be required to acknowledge their receipt and Proof of Delivery. It is Your responsibility to ensure the Goods delivered correspond with Your Order, and the delivery note or invoice. Any discrepancies, or evidence of damage to the packaging and/or Goods, must be noted on the Proof of Delivery documents, atthe time delivery. You must also notify the Company of the damage in writing within 72 hours of delivery.

4.5        Delivery is judged to have taken place when the Goods are delivered and signed for at Your nominated delivery address, where upon any risks arising from loss, damage or breakage are transferred to You.

4.6        Please note that Postal and/or Courier services will require someone to be present to sign for all packages. In the event that this is not possible, a card will be left advising the recipient of the failed delivery, and giving instructions to re-arrange the delivery. In the case of Postal deliveries, the information provided may also include an address from which You can collect the parcel. Failure to comply with these instructions may result in the package being returned to us, at Your expense.

4.7        Overseas deliveries: The Company accepts Orders from  most overseas countries, and will deliver Goods according to the instructions given by the purchaser. It is the purchaser’s responsibility to pay any necessary importation charges for the Goods purchased, and to further ensure that the importation does not contravene local laws or regulations, as may required by authorities in the destination Country.

4.8        Force Majeure: The Company shall have no liability whatsoever in respect of any delay, default or failure to fulfil any obligation described here in in respect of the sale or purchase of Goods, if such delay or default is caused by condition/s beyond its reasonable control.

 

5.0       Cancellation of Order / Returns:

5.1        The Company accepts Your right to cancel Your Order at any time up to seven days after placing it.  You do not need to give us a reason for cancellation, or pay a penalty.

5.2        You must notify us in writing of You intention to cancel Your Order / return any Goods, no later than the end of the 7th working dayafter Ordering.  Assuming Your return is authorised, You will be given a ‘Returns Number’ which must be used on the return-packaging and in all resultant correspondence. This will enable us to identify the returned item/s. Failure to comply with this procedure may result in the return being rejected.

5.3        Upon authorisation of Your cancellation/return You must send the Goods back to us in their original condition / undamaged, to our business address, and at Your own cost and risk.  You must also take reasonable care to ensure that the Goods are appropriately packaged to avoid damage in transit.

5.4        Where cancellation occurs after the Company has processed Your Order / before You receive the Goods, You must return them as soon as is practically possible. In this case, the Goods should be returned unopened in their original packaging.

5.5        If You do not return the Goods in the same condition as they were received, the Company shall be entitled to withhold the amount credited to You, or part thereof. Having cancelled Your Order, You are also under duty to make the Goods available for collection, at Your expense, from the address to which they were delivered. The Company shall then be entitled to full indemnity for any costs incurred inrecovering the Goods

5.6        Upon receipt and processing of the returned Goods, credit orreplacement will be granted, at our discretion, where the Goods display obvious signs of faulty workmanship or are incorrect due to errors on our part. (Please refer to Section 6.0; Warranty).

5.7        Items which have been fitted / used will not be accepted unless by prior agreement, in instances where they are obviously faulty. The fitting of new ‘electrical components’ may result in their damage due to connection to, or faults with, other items within the electrical system. Accordingly, electrical components which have been removed from their original packaging, and / or fitted or used, will not be accepted unless they are obviously faulty.

5.8        Any refund will be made within period of 30 days following Your cancellation, assuming the Goods have been returned according to our Terms and Conditions.

 

 

6.0       Products and Warranty:

6.1        All product descriptions and images are displayed for illustrative purposes only. We take great care in ensuring the accuracy ofthis information and do so in good faith. Parts are listed by their part number and/or description. This does not infer that they were made by any specific manufacturer (OEM) unless stated.   

We endeavour to supply Goods of satisfactory quality, which are fit for their intended purpose. Given the nature of the market for these products some are ‘after-market’, ‘pattern’ or‘copy’ parts, and not genuine OE manufacturers’ parts. Furthermore, in certain instances, products can be  ‘new-old-stock’, by virtue of the fact that manufacturing of the original motorcycles and parts concerned ceased many years ago. Notwithstanding this, the parts are supplied in good faith, subject to these Terms & Conditions.

6.2        Given our commitment to fulfilling Orders in a timely manner, we reserve the right to substitute one brand for another, and in such instances we will provide a replacement product of equal or higher quality.

6.3        It is important for You to satisfy Yourself that the correct part has been selected for the right application.  If You have any concerns regarding the origin, specification, quality or suitability of any item, please contact us inby telephone in advance of Your order.

6.4        Purchasers are expected to apply good judgment in respect of the appropriate selection, installation, use, and maintenance of any supplied parts. Fitting / installation of parts must be undertaken by an appropriately qualified person in accordance with recognised practices and / or the original equipment manufacturers procedures. and service manuals. Motorcycles can be dangerous if they are improperly maintained and/or riddeninappropriately. 

6.5        KL Motorsport Ltd. distributes motorcyclespare parts from many varied sources. We are not a manufacturing Company, nor do we officially represent any specific manufacturer of motorcycles or parts. We have no control over the manufacturing, testing or usage of any part. All Goods are only warranted according to the original manufactures’ own Terms of warranty. All implied warranties including, but not limited to, those for fitness and merchantability, are limited to a duration period ending one yea rfrom the date of purchase. Claims evaluation will be made in a fair and timely manner by the manufacturer or their appointed representative, where possible /applicable.
The original manufacturer will be responsible for any/all claims for damage to person(s) or property arising from design, manufacturing, and testing of its products.
Under no circumstances will KL Motorsport Ltd. be held liable for consequentialor indirect damages. The Company assumes no responsibility for damage or injuryof any kind arising from the misuse or improper application of any parts supplied, by any person.

            Copyright for this website and all its content is owned by KL Motorsport Ltd. All content including but not limited to, Trade-names, Images, PartNumbers, Descriptions, and Logos used, either belong to KL Motorsport Ltd., or are licensed to be used by the corresponding owner, body or Company. KL Motorsport acknowledges copyright and intellectual property rights of manufacturers and suppliers of any products or images which appear on this website. It is forbidden to copy, reproduce, publish, download, or transfer in any way, any part of the content of this website for any commercial or public purposes without written permission, in advance, from KL Motorsport Ltd.

 

8.0       Software disclaimer

The Company does not accept any responsibility for any disruption of or damage to Your computer system, or loss of any data, whilst using this website. Externally Linked Sites are visited at Your own risk. KL Motorsport cannot be held responsible or liable for any links to other websites, nor do we represent, endorse, or warrant any information provided in the course of visiting websites which maybe linked to our site.

 

9.0       Governing Law

All Contracts are conducted in English and any Contract between the Purchaser and  KL Motorsport Ltd., shall be governed by and interpreted in accordance with English laws. English courts shall have exclusive jurisdiction to resolve any disputes.



10.0     General Terms

By visiting this site You agree to be bound by these Terms & Conditions, accepting that they do not affect Your statutory consumer rights.

You further agree not to use this site for any illegal activity accordingto the laws applicable within the Country of viewing the site. 


These Terms and Conditions, together with all information contained within our website, including prices, delivery details, contact details and privacypolicy, constitute the whole of our
agreement relating to the supply of the Goods to You by the Company.


No representation by any person or body on our behalf should be understood as a variation of these Terms and Conditions. 

Should any of the Terms & Conditions contained herein become unenforceable, invalid or  illegal, on the basis of the laws of any country or state in which these Terms & Conditions are intended to be effective, it shall be deleted from the relevant clause. All other Terms & Conditions shall remain and continue to be enforceable and binding
